Sony Music Entertainment and Universal Music Group have launched another copyright lawsuit against AI music platform Suno, opening up a new front in the increasingly important battle over how generative AI companies train music models.<\/p>\n\n\n\n
This time, the argument goes beyond whether copyrighted recordings were originally used to train Suno.<\/p>\n\n\n\n
The labels are effectively asking a much bigger question:<\/p>\n\n\n\n
Can an AI company escape copyright problems simply by training a new AI model using the outputs of an older model?<\/p>\n\n\n\n
Sony and Universal argue that the answer should be no.<\/p>\n\n\n\n
Their latest complaint introduces a particularly memorable term for the practice: \u201cmodel laundering\u201d.<\/p>\n\n\n\n
Sony Music and Universal Music Group filed their second lawsuit against Suno in a Boston federal court on September 18, 2026.<\/p>\n\n\n\n
The complaint alleges that Suno copied 60,202 sound recordings controlled by the two music companies without permission and used those recordings in developing its AI music technology.<\/p>\n\n\n\n
The scale of the claim is significant.<\/p>\n\n\n\n
US copyright law can provide statutory damages of up to $150,000 per copyrighted work in cases where infringement is found to be willful. Applying that maximum to more than 60,000 recordings would theoretically create exposure of more than $9 billion, although actual damages in any case could be dramatically different.<\/p>\n\n\n\n
However, one of the most interesting parts of the new case concerns Suno’s recently launched v6 generation of AI music models.<\/p>\n\n\n\n
Suno launched v6 on September 9, describing it as a new generation of models developed alongside music industry partners including Warner Music Group, BMG and Believe.<\/p>\n\n\n\n
Sony and Universal argue that this does not necessarily solve the underlying copyright issue.<\/p>\n\n\n\n
The labels allege that Suno’s new model has indirectly inherited information from its previous models.<\/p>\n\n\n\n
Their argument is relatively simple.<\/p>\n\n\n\n
Imagine an original AI model was trained using copyrighted music without permission.<\/p>\n\n\n\n
That model can then generate millions of pieces of new audio.<\/p>\n\n\n\n
A company could theoretically take those AI-generated outputs and use them as training material for another AI model.<\/p>\n\n\n\n
The second model may therefore never directly ingest the original copyrighted recording.<\/p>\n\n\n\n
But it may still learn characteristics that the first model extracted from that copyrighted material.<\/p>\n\n\n\n
Sony and Universal describe this process as \u201cmodel laundering\u201d.<\/p>\n\n\n\n
The labels allege that Suno’s new v6 technology was trained partly using outputs or \u201ccreations\u201d produced by previous Suno models. According to their argument, training a new model on those outputs does not necessarily remove the influence of the original training material.<\/p>\n\n\n\n
This could become a very important issue far beyond music.<\/p>\n\n\n\n
Suno has confirmed that user activity played a role in developing v6.<\/p>\n\n\n\n
The company said the model was trained using licensed content from partners as well as interactions from its community, including user \u201ccreations\u201d and preference signals.<\/p>\n\n\n\n
That wording has attracted attention because it suggests actual creations generated through Suno may have contributed to the training process.<\/p>\n\n\n\n
Suno has not accepted Sony and Universal’s legal interpretation.<\/p>\n\n\n\n
The company called the claims fundamentally flawed on both the facts and the law.<\/p>\n\n\n\n
The disagreement therefore creates a fascinating copyright question.<\/p>\n\n\n\n
If an AI-generated song was produced by a model trained using copyrighted recordings, does using that generated song to train another model carry forward any potential infringement?<\/p>\n\n\n\n
There is not yet a simple answer.<\/p>\n\n\n\n
The latest dispute comes after another important development in the original case.<\/p>\n\n\n\n
In a September 2026 court filing, Suno acknowledged that audio data had been obtained from YouTube for use as AI training data using YT-DLP, software commonly used to download media from YouTube.<\/p>\n\n\n\n
Sony and Universal have separately accused Suno of circumventing YouTube’s technological protections to obtain music.<\/p>\n\n\n\n
Suno disputes aspects of those claims and has challenged whether the labels have standing to pursue the stream-ripping allegations.<\/p>\n\n\n\n
The core copyright battle remains centred on whether using copyrighted music to train a generative AI model without permission can qualify as fair use under US law.<\/p>\n\n\n\n
That question could have huge consequences for the entire generative AI industry.<\/p>\n\n\n\n
The situation is particularly interesting because Suno is no longer simply fighting the traditional music industry.<\/p>\n\n\n\n
It is increasingly partnering with it.<\/p>\n\n\n\n
Warner Music Group settled its litigation against Suno in November 2025 and announced a partnership to develop licensed AI music experiences.<\/p>\n\n\n\n
Suno then announced a global partnership with BMG in August 2026.<\/p>\n\n\n\n
Believe and TuneCore followed with another strategic partnership in September, with Believe participating in the development of new Suno music models.<\/p>\n\n\n\n
When Suno launched v6, the company explicitly described Warner, BMG and Believe as industry partners involved with the new generation of models.<\/p>\n\n\n\n
This creates an unusual landscape.<\/p>\n\n\n\n
Some of the largest music companies are now actively working with Suno, while others are continuing to pursue it through the courts.<\/p>\n\n\n\n
Sony and Universal could also use the growing number of licensing agreements as part of their argument.<\/p>\n\n\n\n
One important question in fair-use disputes is whether the allegedly unauthorized use interferes with an existing or potential licensing market.<\/p>\n\n\n\n
If record labels are successfully licensing catalogues for AI training, it becomes easier for rightsholders to argue that there is a functioning commercial market for those rights.<\/p>\n\n\n\n
Sony and Universal have pointed to Suno’s agreements with music companies as evidence that such a market exists.<\/p>\n\n\n\n
Suno, however, has argued that its industry partnerships should not simply be viewed as payments for training data.<\/p>\n\n\n\n
That distinction could become extremely important.<\/p>\n\n\n\n
AI companies may argue that partnerships cover broader products, artist participation and new commercial experiences rather than establishing that every piece of training data requires a traditional copyright licence.<\/p>\n\n\n\n
The biggest question raised by the new lawsuit may have surprisingly little to do with Suno itself.<\/p>\n\n\n\n
Generative AI companies are rapidly producing enormous quantities of synthetic data.<\/p>\n\n\n\n
Future AI models could increasingly be trained using material generated by previous generations of AI rather than directly using human-created source material.<\/p>\n\n\n\n
If courts accept the argument that copyright liability can effectively travel through multiple generations of models, AI companies could face a difficult problem.<\/p>\n\n\n\n
Simply rebuilding a model using synthetic data may not provide a clean legal reset.<\/p>\n\n\n\n
Companies might instead need to demonstrate where their synthetic training data originated and whether the models that generated it were themselves built using properly licensed material.<\/p>\n\n\n\n
That could make data provenance increasingly important.<\/p>\n\n\n\n
For the music industry, this could result in AI licensing becoming less about licensing individual consumer-facing outputs and more about tracking the entire chain of data used to build an AI model.<\/p>\n\n\n\n
The music industry appears increasingly willing to embrace generative AI.<\/p>\n\n\n\n
Warner Music Group’s Suno agreement is one example. Universal has struck AI music partnerships elsewhere, while labels, publishers and artist organisations are experimenting with different models for licensing voices, recordings, compositions and AI training rights.<\/p>\n\n\n\n
Suno itself now appears to be moving towards a model built much more closely alongside established music companies.<\/p>\n\n\n\n
But that does not automatically resolve what happened during the earlier development of AI music platforms.<\/p>\n\n\n\n
Sony and Universal’s latest lawsuit is essentially testing whether an AI company can separate a new generation of technology from the training history of its previous models.<\/p>\n\n\n\n
That question could eventually prove more important than the individual recordings named in the lawsuit.<\/p>\n\n\n\n
If the courts decide that information learned from copyrighted material can effectively remain embedded across generations of AI models, rebuilding an AI model may not be enough to wipe the copyright slate clean.<\/p>\n\n\n\n
