In simple terms, it\u2019s the process of converting and downloading content from streaming platforms like <a href=\"https:\/\/routenote.com\/blog\/free-youtube-music-distribution-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">YouTube<\/a>. It\u2019s been a major piracy headache for music companies for years, and Brazil looks to be taking measures to tackle it to the next level.<\/p>\n\n\n\n<p>While music piracy seems to be declining, Yout is a platform that facilitates streaming ripping, and allows people to download music without going through official streaming platforms. Unsurprisingly, this has landed its US owner, Jonathan Nader, in some hot water.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-wp-embed is-provider-routenote-blog wp-block-embed-routenote-blog\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"wp-embedded-content\" data-secret=\"XCCm8d6mMv\"><a href=\"https:\/\/routenote.com\/blog\/music-piracy-in-europe-down-75-since-2017-is-online-piracy-flattening\/\">Music piracy in Europe down 75% since 2017- is online piracy flattening?<\/a><\/blockquote><iframe class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;Music piracy in Europe down 75% since 2017- is online piracy flattening?&#8221; &#8212; RouteNote Blog\" src=\"https:\/\/routenote.com\/blog\/music-piracy-in-europe-down-75-since-2017-is-online-piracy-flattening\/embed\/#?secret=XCCm8d6mMv\" data-secret=\"XCCm8d6mMv\" width=\"600\" height=\"338\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe>\n<\/div><\/figure>\n\n\n\n<h3>Brazilian prosecutors puts their foot down<\/h3>\n\n\n\n<p>Brazil prosecutors have launched <a href=\"https:\/\/completemusicupdate.com\/yout-stream-ripper-could-face-prison-as-brazil-pushes-ahead-with-criminal-copyright-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">a criminal case<\/a> against Nader, claiming his platform enabled users to illegally download music for profit. If Nader is found guilty, he could face up to four years in jail.<\/p>\n\n\n\n<p>Nader argues that Yout doesn\u2019t host or copy content, and therefore doesn\u2019t infringe upon any copyright. Brazil prosecutors argue the opposite: that Yout makes copyrighted content available which infringes on the right of copyright owners to make their content available.<\/p>\n\n\n\n<p>Nader initially tried to get the case thrown out, saying the prosecutors hadn\u2019t demonstrated \u201cjust cause\u201d and hadn\u2019t provided sufficient evidence. The court judge disagreed, ruling that there was enough information to move forward.<\/p>\n\n\n\n<p>Before heading to trial, Brazilian authorities <a href=\"https:\/\/torrentfreak.com\/brazil-advances-criminal-prosecution-of-american-yout-com-operator\/?ref=completemusicupdate.com\" target=\"_blank\" rel=\"noreferrer noopener\">offered Nader a deal<\/a>. If he agreed to block Brazilian access to Yout, hand over user data about those trying to access his service from Brazil, and pay a fine of about $400,000. In exchange, any criminal prosecution would have been suspended.<\/p>\n\n\n\n<p>Now, the criminal case is heading to court, with a music industry representative expected to testify. The trial is scheduled for August 9, 2025. However, Nader won\u2019t be there in person but will join virtually from the US.<\/p>\n\n\n\n<h3>A win for artists?<\/h3>\n\n\n\n<p>This push from Brazil comes hot on the heels of the Recording Industry Association of America\u2019s (RIAA) action to prevent stream-ripping platforms. In fact, Nader even took <a href=\"https:\/\/torrentfreak.com\/brazil-advances-criminal-prosecution-of-american-yout-com-operator\/?ref=completemusicupdate.com\" target=\"_blank\" rel=\"noreferrer noopener\">the RIAA to court<\/a> in a separate and unresolved case, in order for his site to be declared legal.<\/p>\n\n\n\n<p>Platforms that allow music to be illegally downloaded only hurt artists and rightsholders, who are effectively <a href=\"https:\/\/routenote.com\/blog\/music-piracy-in-europe-down-75-since-2017-is-online-piracy-flattening\/\" target=\"_blank\" rel=\"noreferrer noopener\">losing legitimate sources of income<\/a>. In that sense, Brazil\u2019s move is welcome news.<\/p>\n\n\n\n<p>The criminal charge, however, is a bold new move to tackle music piracy. Most copyright cases usually play out through civil lawsuits, with fines or some kind of injunction.
